A mass tort suit consolidates your claim with the claims of other people (plaintiffs) who have experienced harm from the same drug or device. The goal is to create the strongest case that the product was unsafe and caused serious harm to many people. And typically, a greater number of cases makes for a stronger case collectively. This united front usually results in more compensation for each of the plaintiffs.
A mass tort is very powerful for a few reasons. Most importantly, it is extremely compelling for a jury to hear about numerous people suffering harm from the same source over and over again. It effectively demonstrates how horribly impactful the drug or device was to different people. The consistency of the many stories in a mass tort can be difficult to deny. And when you are going up against a giant pharmaceutical company with a seemingly limitless ability to pay lawyers—anything can help.
Examples of Mass Tort Lawsuits
There are many mass torts that are awaiting trial. Here are a few that are upcoming:
Taxotere - Taxotere (docetaxel) is one of the medications used in chemotherapy treatments for women who suffer from breast cancer. Unfortunately, Sanofi-Aventis, the makers of this drug, failed to warn their patients of the risk of permanent alopecia (hair loss).
Invokana - Invokana (canagliflozin) is a medication made by Janssen Pharmaceuticals, a subsidiary of Johnson & Johnson, that has been prescribed to patients who suffer from type 2 diabetes. Adverse effects are being reported which include diabetic ketoacidosis, kidney failure, amputation of the leg or foot, coma, stroke, heart attacks and even death.
Viberzi- Viberzi (eluxadoline) is a drug made by Allergen that’s supposed to help relax the muscle spasms in the intestines for those who suffer from Irritable Bowel Syndrome with Diarrhea (IBS-D). Not only is Viberzi an opioid which is highly addictive, but it can also cause pancreatitis and even death.
Roundup - Monsanto makes Roundup, one of the most popular weed killers in the world, but countless people who have been in contact with this toxic product are now being diagnosed non-Hodgkin lymphoma, a type of cancer that attacks the immune system.
Physiomesh - Ethicon, a division of Johnson & Johnson, made Physiomesh as a device to help repair hernias by reinforcing torn abdominal tissue. However, this screen-like material can erode and move around in the body causing hernia recurrence, perforation of organs and severe infections that may result in hospitalization and additional surgeries.
Actemra - Genentech, a member of the Roche group, formulated Actemra for patients who suffer from various types of arthritis. Many have experienced the following complications: heart failure, heart attack, stroke, pancreatitis, interstitial, lung disease, gastrointestinal perforations and death.
TVM - Countless women have had transvaginal mesh (TVM) inserted into their vaginas for bladder/organ prolapse (POP) or stress urinary incontinence (SUI). Much like Physiomesh, this mesh can migrate and erode causing organ perforations, painful sexual intercourse and result in other debilitating conditions.
IVC Filters - Inferior vena cava (IVC) filters are cone shaped devices made from wire that can be placed into a vein to catch blood clots before they travel to the lungs or heart causing life-threatening complications. While this may sound like a great product, it has been known to break apart and these metal barbs can travel through the body to puncture organs and tissue.
Talcum Powder - Most people associate Johnson & Johnson’s Baby Powder with freshness and use it in their daily routine. When talc is used regularly in the vaginal area, it has been known to cause ovarian cancer.
Risperdal - Made by Johnson & Johnson, Risperdal was prescribed to boys who suffer from psychotic disorders including schizophrenia and autism. After taking this drug, innumerable boys have reported having gynecomastia, an embarrassing condition where males grow breasts.
