In Louisiana, over 1,100 pretrial cases have been consolidated for patients who have been treated with Taxotere and are now struggling with permanent alopecia (hair loss). With so much action happening around these cases, many believe this trial (which could take place in November or December) will indicate how future trials with this issue may be settled. In this post we will inform you of the the most recent news about lawsuits against Sanofi and what this could mean for patients who who are suffering from permanent alopecia due to using this drug.
The first settlement between Sanofi-Aventis and the many injured parties will be located in Louisiana. According to court documents dated October 13, 2016, “All the actions share common factual questions arising out of allegations that Taxotere (docetaxel), a chemotherapy drug, causes permanent hair loss, that defendants were aware of this possible side effect and failed to warn patients, and that defendants marketed Taxotere as more effective than other chemotherapy drugs when other drugs were equally effective without the associated permanent hair loss. Plaintiffs in these actions each allege that they experienced permanent hair loss as a result of using Taxotere.”
Sixteen districts are being represented in this bellwether case. This means that in this instance, there are twelves states being represented with plaintiffs from those various states. All of these plaintiffs have the same grievance against Sanofi-Aventis: they weren’t warned of the potential risk of permanent alopecia from using this drug and are now suffering from this debilitating adverse effect.
Pretrial proceedings have been established in the Eastern District of Louisiana since October 2016 to reduce duplicating common complaints involved in the cases, to avoid pretrial rulings that may conflict with one another from different courts and to make it easier for the parties, witnesses and the courts while also reducing court costs.
